Participant Waiver & Release
All participants must complete this waiver before boarding. Please read carefully and sign below.
RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK & INDEMNITY AGREEMENT
TO: Yellow River Pontoon Adventures, its owners, operators, employees, agents, representatives, and assigns (collectively "the Company").
In consideration of being permitted to participate in pontoon boat tours, river cruises, sandbar outings, bonfire experiences, and any related activities (collectively "the Activities") operated by Yellow River Pontoon Adventures departing from 7804 Glendenning Rd, Danbury, WI 54830, I, the undersigned participant, acknowledge and agree to the following:
1. ASSUMPTION OF RISK
I understand that participation in the Activities involves inherent risks, dangers, and hazards including, but not limited to: drowning, capsizing, collision with other vessels or objects, weather conditions, slippery surfaces, wildlife encounters, personal injury, property damage, and death. I voluntarily accept and assume all such risks, known and unknown, associated with participation in the Activities.
2. RELEASE OF LIABILITY
I hereby release, waive, discharge, and covenant not to sue Yellow River Pontoon Adventures and its owners, operators, employees, and agents from any and all claims, actions, damages, liability, and expenses in connection with loss of life, personal injury, or damage to property arising from my participation in the Activities, whether caused by negligence or otherwise.
3. INDEMNIFICATION
I agree to indemnify and hold harmless Yellow River Pontoon Adventures from any loss, liability, damage, or costs they may incur due to my participation in the Activities, whether caused by negligence or otherwise.
4. RULES & CONDUCT
I agree to follow all safety instructions given by the captain and crew. I understand that intoxicated participants may be refused boarding or removed from the vessel for the safety of all guests. I will not operate the vessel under any circumstances unless explicitly authorized.
5. LIFE JACKETS
U.S. Coast Guard–approved personal flotation devices (PFDs) are available onboard. I understand it is my responsibility to wear one at my own discretion and as required by applicable law.
6. GOVERNING LAW
This agreement shall be governed by the laws of the State of Wisconsin. Any disputes arising hereunder shall be resolved exclusively in the courts of Burnett County, Wisconsin.
7. ACKNOWLEDGMENT
I have read this agreement, fully understand its terms, and sign it freely and voluntarily without any inducement. I am 18 years of age or older, or have obtained parental/guardian consent. This agreement shall be binding upon me, my heirs, executors, administrators, and assigns.
